Terms of Service

Last updated: April 4, 2024

Important Notice

HelioWallet is an experimental research project built primarily for educational and research purposes. It is NOT a commercial product, and it is NOT intended for storing or managing significant amounts of cryptocurrency.

If you intend to manage real cryptocurrency assets of any significant value, we strongly recommend using well-established, professionally audited wallets such as MetaMask, Ledger, Trezor, Trust Wallet, or other reputable wallet providers that have undergone extensive security audits.

By using HelioWallet, you acknowledge that you do so entirely at your own risk. The developers, contributors, and operators of this project accept absolutely no responsibility for any loss of funds, data, or any other damages arising from the use of this software.

1. Acceptance of Terms

By accessing, using, or interacting with HelioWallet in any way, you unconditionally agree to be bound by these Terms of Service in their entirety. If you do not agree to any part of these terms, you must immediately cease all use of the service. Your continued use of HelioWallet constitutes ongoing acceptance of these terms, including any modifications made after your initial acceptance.

2. Nature of the Service

HelioWallet is an experimental software project created for educational and blockchain technology research purposes. The service provides a self-custody cryptocurrency wallet interface that allows users to interact with various blockchain networks.

This software is provided as a research tool and proof-of-concept. It has not undergone formal security audits, penetration testing, or any professional review process. The codebase may contain bugs, vulnerabilities, or errors that could result in the loss of cryptocurrency assets.

HelioWallet is not a financial institution, money transmitter, exchange, broker, fiduciary, or custodian. We do not hold, manage, or have access to your funds at any time.

3. No Financial Advice

Nothing contained in HelioWallet, its website, documentation, or any associated materials constitutes financial, investment, tax, legal, or any other form of professional advice. Any information displayed (including but not limited to token prices, balances, market data, and transaction details) is provided solely for informational and educational purposes and should not be relied upon for making financial decisions.

You should consult qualified financial advisors before making any cryptocurrency investment or transaction decisions. We make no recommendations regarding the purchase, sale, or holding of any cryptocurrency or digital asset.

4. Self-Custody & User Responsibility

HelioWallet is a self-custody wallet. You bear sole and complete responsibility for:

  • Your private keys, mnemonic phrases, passwords, and all credentials
  • The security of your device and browser environment
  • Verifying all transaction details (recipient address, amount, gas fees, network) before confirming
  • Maintaining secure backups of your recovery phrase
  • Understanding the blockchain networks and tokens you interact with
  • Complying with all applicable laws and regulations in your jurisdiction
  • Any and all consequences of your use of this software

We cannot recover lost or stolen private keys, reverse or cancel any blockchain transactions, access your wallet or funds in any way, or provide customer support for lost funds.

5. Assumption of Risk

You expressly acknowledge and accept the following risks associated with using HelioWallet:

  • Software Bugs: As experimental software, HelioWallet may contain defects, errors, or vulnerabilities that could result in the total loss of your cryptocurrency assets
  • No Security Audit: This software has not been professionally audited. There may be unknown security vulnerabilities
  • Price Volatility: Cryptocurrency values can fluctuate dramatically and you may lose the entire value of your holdings
  • Irreversible Transactions: Blockchain transactions cannot be undone. Sending funds to a wrong address means permanent loss
  • Network Risks: Blockchain networks may experience congestion, forks, attacks, or failures beyond our control
  • Third-Party APIs: We rely on external services (blockchain RPCs, price feeds, data providers) that may be inaccurate, unavailable, or compromised
  • Smart Contract Risks: Interacting with smart contracts (swaps, token approvals) carries inherent risk of loss
  • Regulatory Risks: Cryptocurrency regulations may change in your jurisdiction, potentially making certain activities illegal
  • Device Security: If your device is compromised (malware, keylogger, unauthorized access), your assets may be stolen

You acknowledge that you use HelioWallet entirely at your own risk and that you have sufficient knowledge and experience to evaluate the risks involved.

6. Recommendation to Use Established Wallets

We strongly advise that for any real-world cryptocurrency management involving funds of meaningful value, you use well-known, professionally audited, and widely trusted wallet solutions such as:

  • Hardware wallets (Ledger, Trezor)
  • Established software wallets (MetaMask, Trust Wallet, Coinbase Wallet, Rainbow)
  • Other wallets that have undergone comprehensive security audits

HelioWallet should be treated as a learning tool and research project, not as a primary or production-grade wallet for storing valuable assets.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELIOWALLET AND ALL ASSOCIATED SOFTWARE, SERVICES, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION OR DATA
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SOFTWARE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

No advice or information, whether oral or written, obtained from HelioWallet or through the service shall create any warranty not expressly stated herein.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HELIOWALLET, ITS DEVELOPERS, CONTRIBUTORS, OPERATORS, AFFILIATES, OR ANY ASSOCIATED PARTIES BE LIABLE FOR ANY:

  • DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR CRYPTOCURRENCY ASSETS
  • COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
  • DAMAGES RESULTING FROM ANY TRANSACTION OR INTERACTION WITH BLOCKCHAIN NETWORKS
  • DAMAGES ARISING FROM BUGS, ERRORS, OR VULNERABILITIES IN THE SOFTWARE
  • DAMAGES ARISING FROM THIRD-PARTY API FAILURES OR INACCURACIES

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ZERO DOLLARS ($0.00 USD).

9. Indemnification

You agree to indemnify, defend, and hold harmless HelioWallet, its developers, contributors, operators, and all associated parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use or misuse of the service
  • Your violation of these Terms of Service
  • Your violation of any applicable law or regulation
  • Any loss of cryptocurrency assets while using the service
  • Any claim by a third party arising from your use of the service

10. Prohibited Uses

You agree not to use HelioWallet for:

  • Any illegal activity, including money laundering, terrorist financing, or sanctions evasion
  • Fraud, scams, or any deceptive practices
  • Any activity that violates the laws or regulations of your jurisdiction
  • Attempting to exploit, hack, or attack the service or its infrastructure
  • Any commercial use without explicit written permission

11. Third-Party Services & APIs

HelioWallet integrates with various third-party services and APIs (including but not limited to blockchain RPCs, price data providers, and block explorers). We have no control over these services and assume no responsibility for their availability, accuracy, security, or content. Your use of any third-party service is subject to that service's own terms and privacy policies.

12. Service Availability

We make no guarantee regarding the availability, uptime, or continuity of HelioWallet. The service may be discontinued, modified, or become unavailable at any time without prior notice. We are under no obligation to maintain, support, or update the service.

13. Changes to Terms

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion, without prior notice. Changes become effective immediately upon posting. Your continued use of the service after any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and HelioWallet regarding the use of the service and supersede any prior agreements.
